More than six months after a Pennsylvania state trooper shot Daryl Berry on the turnpike, state police ruled the shooting justified.
Pennsylvania State police determined that a trooper used the appropriate level of force when he shot and killed a Columbia man in March, according to a state police spokesman. Corporal Richard Dean told Patch on Thursday that state police had closed the case and found that Trooper Marshall Kephart was facing an attack when he shot and killed Daryl Berry on March 6. The shooting occurred on the turnpike in Brush Creek Township in south-central Pennsylvania. Dean said that the Fulton County District Attorney's office, which also investigated the shooting, agreed with the state police's findings. The mother of Daryl Berry, a Columbia native, wonders why Pennsylvania State Police have not released information related to the shooting death of her son.
A man who grew up in Columbia and police said was shot on the Pennsylvania State Turnpike in March by a state trooper had no controlled substances in his system, according to the Fulton County coroner in Pennsylvania. The shooting death of former Columbia resident Daryl Berry on the Pennsylvania Turnpike remains under investigation.
Pennsylvania State Police have released the name of the trooper who shot and killed former Columbia resident Daryl Berry in what police describe as an altercation on the Pennsylvania State Turnpike on March 7. Maria Finn, press secretary for the state police, said in an email Wednesday that trooper Marshall Kephart shot Berry in the incident. Kephart said he reacted in self-defense and that Berry turned his dogs loose and then beat the officer with a flashlight, according to news reports. The incident is under investigation by the state police, said Finn. Kephart was placed on administrative leave for five days after the shooting, according to Finn. He was reinstated on March 13.
