Final arguments in the Howard County school board's case against Dyer are scheduled for Wednesday.
Testimony continued Friday after a judge Wednesday denied a motion to dismiss the charges in the hearing to remove Allen Dyer from the Howard County Board of Education, the Howard County Times reported. The Baltimore Sun reported that during Wednesday’s testimony, Dyer responded to individual accusations laid out in the complaint, filed by the Board of Education in June of 2011, which sought to have Dyer removed by the state from his position on the Board. Included in the accusations were charges that Dyer had breached confidentiality rules and that his repeated lawsuits against the Board had made it difficult for the Board to function. Dyer, known for suing the Board, is now suing individual members.
Allen Dyer is headed back to court. According to the Baltimore Sun, Dyer had four members of the Howard County Board of Education, on which he sits, served with a civil complaint just before recess at Tuesday evening’s board meeting.. According to court records the complaints -- against Frank Aquino, Sandra French, Ellen Flynn Giles and Janet Siddiqui – were filed with the Circuit Court on May 9. Dyer told the Sun that he waited nearly two weeks to have them served because it was convenient having all four together at once. The complaint accuses the four of violating Open Meetings Act requirements in sevaral instances during the search for a new superintendent, according to the Sun. An administrative judge will consider dropping the Howard County Board of Education's request to remove board member Allen Dyer from his seat because the charges were unclear, the Howard County Times reported. At Tuesday's hearing, the fifth day of testimony, Administrative Law Judge Douglas Koteen said he would consider a second appeal by Dyer to have the charges dismissed. Koteen had denied a previous request to dismiss the charge. The Board of Education in June asked the State Board of Education to remove Dyer from his position, accusing him of breaching confidentiality provisions, undermining the board and using his position to "further his personal litigation against the Board of Education,” among other allegations. Two incumbents revealed information about process of selecting the school system's new leader.
Some candidates running for the three open seats on Howard County's school board said the Board of Education lacked openness in its decision this week to select Renee Foose, deputy superintendent in Baltimore County, as the new superintendent of Howard County schools. That contention was supported by at least one member of the current school board. “I am very pleased with the candidate we ended up with,” said incumbent Allen Dyer. “However, the process was fatally flawed." If Allen Dyer is ousted from the Howard County School Board, it won’t be without a fight. “The gloves are off,” Dyer said in an interview. “Very clearly the gloves are off and I am a red-blooded American. The Howard County School Board has sent its official request to have Allen Dyer removed.
The Howard County School Board has officially requested that the State Board of Education remove board member Allen Dyer from his seat on the board. A letter dated June 24, and signed by Chairperson Janet Siddiqui states: "As the resolution (see attached) adopted by the Board of Education states, Mr. Dyer has engaged in a pattern of behavior that the board believes constitutes misconduct in office." Among the specific allegations: The text of the letter to the State Department of Education is available with this article. According to the Maryland Code, Dyer has 10 days to request a hearing, which he has said he intends to do.
